Grefe & Sidney, PLC wins at the Iowa Supreme Court! On March 20, 2015, the Iowa Supreme Court decided, in Amish Connection vs State Farm Fire and Casualty Company, that the rain limitation language contained in State Farm Fire and Casualty’s insurance policy does not cover water damage inside a building that resulted when an interior drain pipe burst during a summer rainstorm. The Court decided that the policy only insures damage caused by rain if an insured event first ruptures a roof or exterior wall so as to allow rain to enter the premises or if the damage results from melting ice or snow. State Farm’s argument, which the Supreme Court adopted, was that to decide otherwise would allow the policy to be used to provide coverage for delayed or inadequate maintenance.
