During the week of April 25, 2016, Clark Mitchell obtained a defense verdict in favor of the president of a townhome owners association. Mitchell represented one of three defendants in the suit. The defendants suspected the plaintiff had misappropriated money from the association. The defendants provided information of plaintiff’s activities to the police. The plaintiff alleged that the defendants made defamatory statements to the police which caused the plaintiff to be charged with the crime of theft. The plaintiff’s wife also asserted a claim seeking loss of consortium damages. Additionally, the plaintiff sought punitive damages. After a five-day jury trial, the Scott County jury returned a defense verdict on all counts finding the defendants did not defame plaintiff. The jury’s verdict allowed no recovery for plaintiff or his wife.
