Mark Thomas and Stella Maris Strohman recently won a motion for summary judgment in defense of a convenience store in a slip and fall case in Monona County. The case arose after the plaintiff allegedly slipped and fell on ice outside the convenience store on February 21, 2021. The plaintiff filed his petition on February 23, 2023. The statute of limitations for personal injury cases in Iowa is generally two years. Because the petition had been filed outside of two years, Mark and Stella Maris moved to dismiss the case, which the plaintiff resisted. After a hearing, the Court entered an order granting the motion for summary judgment, finding that there were no legally sufficient excuses for why the petition had been filed after the two-year mark, and so dismissed the lawsuit.
